
Just days after the High Court nullified his election, Kawempe North MP Erias Luyimbazi Nalukoola made a surprise return to Parliament yesterday, causing a stir and raising questions about the legal implications of his presence.
The court had ordered the Electoral Commission to organize a fresh election, but it appears there is no law stopping him from accessing Parliament at least not yet.
“My legal team filed a notice of appeal within the seven-day period allowed under the Parliamentary Elections Act,” Nalukoola told journalists. “Until the appeal is decided, I will continue to serve as MP.”
What Does the Law Say?
According to the Parliamentary Elections Act, once a candidate files a valid appeal, the High Court ruling does not immediately take effect.
This means Nalukoola can legally continue representing Kawempe North while waiting for the Court of Appeal’s final decision.
With the legal battle still unfolding, many are watching closely to see if the Court of Appeal will overturn the ruling or confirm the need for a by-election.
